Abstract

Constitution of India remarks the speedy Trial as a fundamental Right Guaranteed under Article 21 of the Indian Constitution. The factors responsible for the delay of the Trial are like as court system and due to the professional courtesy of lawyers. An accused or a dependent can apply for speedy Trials in the Hon'ble High Court or Supreme Court by filling a Writ Petition under Article 226 and Article 32 of the constitution. Delay in Trial of the case confers a right upon the accused to apply for Bail under Section 482 and 483 of the criminal procedure code, 1973 lays that every possible measure to be taken to dispose of the case within time limit to protect the right of the speedy trial of an accused.
